1. By entering Hi-5 weekly by Cong. Shevet Achaim [“CSA”], you agree to be bound by the following terms and conditions.
2. CSA is a recurrent raffle, in which all raffle purchasers enter the raffle drawing each and every week on Thursday [besides when Jewish holiday is on Thursday the raffle will be made prior to holiday].
3. By donating $180 once, the donor enters the raffle every single week of the year [52 weeks]. One donating $360 will enter each raffle 3 times, and by donating $500 he will enter 6 times weekly.
4. The winner will receive $5000. One winner can still continue winning in the upcoming raffle drawings.
Eligibility
5. Entry is open to all donors who have signed up for either 1 time payment of purchase, or in recurring monthly payments. One is subject to entry only after first payment has cleared. If a recurring payment will be denied or stopped, that donor will no longer enter the following drawings until balance will be paid off.
Prizes
6. There is one (1) weekly prize draw in the amount of $5000. The first eligible entry drawn will receive the Prize.
7. Each weekly prize consists of a $5,000 cash prize.
8. CSA will make reasonable efforts to notify winners that they have won. If, after reasonable efforts have been made by CSA, the winner cannot be contacted within 5 business days of the monthly prize draw, CSA may at its discretion: (a) deem the winner to have forfeited their right to the Prize; and (b) re-draw another eligible winner in accordance with these terms and conditions.
9. The winner will be contacted by CSA using the contact details held by CSA and will be provided with details on how to collect their Prize. Winner must provide a valid driver’s license and Social Security number and must execute a form 1099 or other tax form as necessary in order to collect their Prize.
10. All taxes, including sales tax, State and Federal income tax, and any withholding tax, are the sole responsibility of the Prize winner. Any other costs, fees, taxes or expenses not explicitly stated herein are the Prize winner’s sole responsibility. The winner is encouraged to consult with a tax advisor or financial specialist to determine tax consequences of winning the Prize.
11. The Prize is not transferable and cannot be exchanged for any other prizes.
12. CSA’s decision is final and binding and no correspondence will be entered into.
13. CSA reserves the right to change the specifics of any Prize at its sole discretion, however it is highly unlikely.
General
14. CSA reserves the right to terminate or amend any aspect of this Promotion without notice at any time.
15. CSA is not responsible or liable for any winner’s inability to use his/her Prize or for any tax liabilities that the winner may incur as a result of the Prize.
16. CSA does not offer refunds. A non-profit organization is not required to grant a donor’s request for a refund.
17. CSA, its directors, employees, students, contractors, agents, attorneys, accountants and successors takes no responsibility for any misdirected, lost, incomplete, damaged, corrupted, incorrectly submitted or late entries, or any human error, technical malfunctions, lost or delayed data transmission, computer or network failure, or any other interruption that may affect the conduct of this Promotion or the prize draw, and all Eligible Customers hereby waive and release any and all claims they may have against CSA, its directors, employees, students, contractors, agents, attorneys, accountants and successors in relation to such errors.
18. CSA, and its directors, employees, students, contractors, agents, attorneys, accountants and successors will not be liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with Hi-5 weekly or any Prize, and the Eligible Customer and winner agrees to fully release CSA, its directors, employees, students, contractors, agents, attorneys, accountants and successors from any such claims, and indemnify, defend, and hold CSA harmless against any loss, damage or expense incurred by CSA by reason of any action or omission of the Eligible Customer, the winner and their agents.
19. These terms and conditions will be governed by New York law, and jurisdiction over any and all disputes shall be exclusive to the state and federal courts of New York, NY.
Privacy
20. Information collected from all entries will be securely held by CSA. CSA may contact any or all entrants using the contact details provided in their entries for the purpose of Hi-5 weekly generally and for marketing and promotional purposes. CSA may disclose entrants’ personal information to its contractors and agents in the course of conducting this Promotion and for marketing and promotional purposes. All entrants have the right to access and correct their personal information by contacting CSA in writing at the address listed.
21. Winners consent to the use of their names, likenesses and photographs without compensation for publicity purposes to help promote CSA and its programs.
